PRIVACY POLICY

1.1. The present policy on confidentiality (privacy) and personal data protection (hereinafter referred to as the “Policy”) sets rules and procedures according to which Limited Liability Company “LSP Global”, being the owner of the domain name tipmymenu.com (hereinafter referred to as the “Company”, “We”) collects and uses personal information of Users received through the website tipmymenu.com (hereinafter referred to as the “Site”). The Company emphasizes that it respects the rights of Users to protect their personal data and therefore it has approved the present Policy to ensure the implementation of the said rights.

1.2. The Policy is an official document of the Company, registered at the address: 6, PROSPECT BANDERY, KIEV, 04073.

1.3. The procedure of User personal data processing is regulated by this Policy, the Terms of use of the Site and current legislation of Ukraine.

1.4. The Policy has been developed according to the Terms of use of the Site published by link https://www.tipmymenu.com/ru/content/agreement. In case of contradictions between the provisions of this Policy and other documents posted on the Site the provisions of the Policy must apply.

1.5. Within the present Policy the words “including” and “includes” have the meaning “including but not limited to”.

 

2. Definition of Terms

2.1. User – an individual (physical person) who submits his/her personal data when using the Site and/or any services provided by the Company.

2.2. Personal data – information or  set of data about the person being identified or that can be definitely identified including but not limited to the following: name, surname, patronymic, age, phone number, gender, date of birth, city, country of residence, photo, electronic mail address, as well as other information the Company would need to carry out for the purposes specified by the present Policy.

2.3. Personal data processing -   any action or set of actions with personal data including but not limited to the following: collection, receipt, registration, accumulation, entry to the data base, storage, adaptation, change, updating, use and dissemination, transfer to third parties, destruction and other actions with Personal data including the use of information systems.

2.4. ​​Owner of personal data  - an individual (physical person) or legal entity that defines the purpose of personal data processing, determines the composition of these data and procedures of their processing unless otherwise specified by law. According to this Policy the owner of the personal data of Users shall be the Company.

 

3. Aims of Collection and Processing of Information

3.1. We may collect and store information about the User when he/she uses the Site. We use this information in order to fulfill the obligations of the Company to Users regarding the use of Site pursuant to the Terms of Use of the Site, namely for: execution of User's requests, realization of functional capabilities of the Site including for registration of the User on the Site and provision of the possibility to comment on the Content of the Site, for improvement of the quality of the Site, tracking of the use of the Site, provision of customer support to the Users of the Site, for exchanging of messages with the Users and enhancement of the security of the Site as well as for compliance with legal obligations in accordance with the present Policy and Terms of Use of the Site.

3.2. Information being collected by technical means may be used for statistical purposes, for improvement of functionality and convenience of the Site to its Users.

 

4. User Consent to his/her Personal Data Processing

4.1. When registering on the Site the User consents to processing of his/her personal data by the Company by making an appropriate mark in a dedicated box “I agree with the Privacy Policy”, in accordance with the Law of Ukraine “On Protection of Personal Data” and on the terms stipulated by this Policy. By registering on the Site the User is consenting to the use, processing of his/her Personal data, including the consent for collection, storage,  accounting, accumulation, adaptation, change, recovery, use and dissemination (transmission) as well as execution of other actions within the limits of current legislation.

4.2. If the User not agree with the Policy or its separate provisions the possibility of using the Site will be restricted for him/her.

4.3. By giving consent for Personal data processing the User confirms that he/she knows his/her rights as a Personal data subject, stipulated by the current legislation, and the purpose of use of his/her Personal information by the Company.

 

5. User Rights as a Subject of Personal Data

5.1. The User as a subject of Personal data has the following rights:

  • to know the sources of Personal data collection, location of his/her Personal data, the purpose of Personal data processing, whereabouts and/or the place of residence of the Owner of Personal data, or to give a respective  instruction to the authorized persons of the User to obtain such information except as provided by law;
  • to receive information on the terms of providing access to the Personal data of the User as well as, for example, information on provision of the Personal data of the User to the third parties;
  • to get access to Personal data of the User;
  • to get an answer on whether the Personal data of the User are processed within thirty calendar days from the moment of getting a request except as provided by law, as well as to receive the content of Personal data of the User kept by the Company;
  • to submit a reasoned claim with objection against processing of Personal data of the User;
  • to submit a reasoned request to modify or delete the Personal data by any owner if the data are processed illegally or are invalid;
  • to protection of his/her Personal data from illegal processing and accidental loss, destruction, corruption caused by deliberate hiding, failure to provide or late submission as well as to protection against submission of information being unreliable or defaming the honor, dignity and business reputation of the User;
  • apply with complaints against processing of his/her Personal data to the Official protecting human rights (Ombudsman) or to the court;
  • to use legal remedies in case of infringement of the personal data protection legislation;
  • to introduce reservations concerning the restriction of the right to process his/her Personal data when giving a consent for processing;
  • to recall the consent for Personal data processing;
  • to know the mechanism of automated processing of the Personal data;
  • to be protected against automated decision having legal consequences for the User.

 

6. Processed Information and its Use

6.1. The Company processes the Personal data provided voluntarily by the Users during registration and/or when performing other actions on the Site.

6.2. Categories of processed information. The Company collects via Site and processes the information of two categories:

  • Personal data provided by the Users. Due to the fact that permission of access to the entire functionality of the Site envisages the registration of the User on the Site and creation of an account of a User, the Company in connection with the above gathers the following categories of data: personal data of Users – physical persons (individuals), personal data of Users – representatives of legal entities being provided in the process of registration on the Site;
  • Categories of information collected by automatic means. Besides data provided by the Users by themselves, the Company may gather automatically certain type of data in the process of User visiting the Site as well as the addresses of electronic mail which the User provides to the Company during registration. We may keep information on the usage of the Site by the User including search queries of the User, pages the User visited, date and time when the User visited the Site. We may keep information provided by User's computer during the use of the Site, such as the browser type, used by the User, type and parameters of computer or mobile device, browser language, IP address.

6.3. By using certain functionality of the Site (for example, while registering on the Site), the User agrees to receive messages directly from the Administration of the Site. The User may refuse to receive certain administrative or legal messages from the Administration of the Site but such refusal may influence the possibility of using the Site by the User. Having the possibility to send messages to the User by the Administration of the Site as stated above, we may also track the actions the User takes in response to such messages, for example, are they deleted by the User, has he/she opened or transferred such messages. We may also store information which the User provides through the communication channels of the Company including e-mail messages and other electronic messages.

6.4. The Personal data of the Users  are stored solely on electronic carriers and are processed with the use of automated systems, except for instances when non-automated treatment of personal data may be needed in connection with the fulfillment of the requirements of current legislation. 

 

7. Registration and Authorization on the Site

7.1. When registering on the Site the User undertakes to submit the complete, trustworthy and accurate information in volume needed for the use of the Site.

7.2. The Administration of the Site does not carry out checking of the authenticity of information, submitted by the User except for instances when such checking is needed for fulfillment of the functions provided by the Site and execution of the obligations of the Company before the User in accordance with this Policy.

7.3. Registration on the Site is carried out according to the form provided on the Site. For authorization of access to the Site the User has to indicate login chosen during registration (it can be the address of electronic mail) and a password. The User is solely responsible for login and password keeping. The User has no right to transfer his/her own login and a password to the third parties and is liable to take measures to protect the confidentiality of the login and a password.

 

8. The third Parties

8.1. The Company does not transfer the Personal data of the Users to third parties except for a limited number of cases when the third parties may receive information about the User in order to provide services by the Site, namely:

  • Service providers. We may use the services of external providers for support or provision of services which are available or may be available through the Site in future, realization of functions of the Site (such as communication means, including sending of messages by the Site, hosting services, network security, technical and customer support, tracking and reporting of functions, testing, quality control, marketing information collection as well as other functions). We may transfer information from or about the User to these external providers for them to be able to provide their services or to fulfill the requests of the Users. These external providers may exchange information with the Company which they obtain from or about the User in connection with the provision of their services or fulfillment of the requests of the Users.

You acknowledge and confirm that different terms of use and privacy policy may be applicable to the use of services of external providers and their content. In no way we  support external Sites and under no circumstances will we be liable for any services of such external providers.   Such external providers are not the parties to this Policy and do not bear responsibility for provision or furnishing of the Site in any way. Access of the User to the Site with the use of services of such external providers is subject to the terms of the appropriate terms of use of such sites and their privacy policy.

  • Links. The Site may contain links to third party resources. Except as provided in the present Policy we do not submit Personal data of the Users to such third parties and shall have no responsibility for the privacy policy of such third party resources. We  assume that the User has got familiarized with the privacy policies applied to such third party resources.

 

9. Security and Data Protection

 

9.1. We take measures to protect User personal data, providing adequate level of data protection in compliance with the standards  established by the legislation of Ukraine and European Union. Please pay attention to the fact that the Company is the Owner of the Personal data, responsible for protection of the Personal data of the User in connection with his/her use of the Site. To receive additional information on your Personal data and their use by the Site, please contact us by an electronic address: [email protected]. We'll respond to properly made out inquiries concerning personal data processing within 30 days from the moment of receipt of the inquiry or as provided by current legislation.

9.2. We would like also to draw your attention to the fact that no method of data transmission over the Internet or method of electronic storage of information is 100% secure. Thus, although we strive to use commercially acceptable means to protect Personal data of the Users we cannot guarantee absolute security of such means.

 

10. Changes to this Privacy Policy

10.1. The Site may update this Policy at any time, and any changes will come into effect after being posted on the Site. Should substantial changes  are introduced relating to how we maintain Personal data of the Users we shall show a notice through the Site before coming of such modification into force. We may at our own discretion notify the User by electronic mail. Nevertheless, we shall use the Personal data of the User in accordance with the Privacy Policy being in force at the moment of sending information if the User does not agree to the new or revised Policy.
